In our immediately preceding blog post (April 12), we highlighted the variety and number of criminal charges that can attach in a single traffic incident. The subject matter of that post related to the events that unfolded following a state trooper's attempt to stop a motorcyclist from speeding. Ultimately, numerous charges were filed against the man.
As we noted, obtaining experienced legal counsel in such a case can have a material effect on the outcome, as the criminal process for traffic violations -- e.g., procedures, deadlines, paperwork and hearings -- can be complex, confusing and onerous.
Another Gwinnett County resident who has recently been involved in multiple traffic-related matters can readily attest to that. The man, from Dacula, was recently arrested in Buford after a police officer there responded to a call of a stranded motorist. The officer stated that the man was unfit for driving and could not undergo field sobriety tests. He was placed under arrest for DUI, and his car was impounded.
A search of the car uncovered various types of prescription drugs, marijuana, and alcohol, including tequila and beer. The man was charged with DUI, marijuana possession and possession of schedule II and IV narcotics.
One week prior to that incident, the man was arrested for DUI by the Gwinnett County Police Department DUI Task Force. In January of this year, he was also arrested pursuant to a traffic stop for possession of less than one ounce of marijuana.
DUI and other traffic violations can bring harsh penalties, including jail time and substantial fines. Every defendant has a right to a strong legal defense and close examination of all the evidence.
