It will take an experienced DUI defense attorney some time to sort through and determine how to best respond to the long litany of charges a Stone Mountain man is facing following his recent arrest after a Gwinnett County police officer stopped him for allegedly racing on Interstate 85 while intoxicated.
The Gwinnett County Sheriff's Department stated that the officer first spotted the 31-year-old man as he was racing on the highway just before 10:30 p.m. on July 3 with two other vehicles, with each car reaching speeds of up to 120 miles per hour (the source media report did not indicate whether the other drivers were stopped or charged).
When the man was pulled over, the officer discovered that there were three other people in the car, all young boys, including the man's son.
The police report stated that a strong smell of alcohol was coming from the car, although the man initially denied that he had consumed any alcohol. The officer stated that he subsequently changed his story, saying that he had consumed a single drink "at 2 o'clock at the latest." The officer said that the man stumbled backwards as he exited the car. He declined to take a breath test.
According to jail records, the driver was arrested in Gwinnett County in 2000 for racing and speeding. His most recent charges include driving under the influence, speeding, racing, reckless driving and three counts of DUI-child endangerment.
